iApp Technologies LLP — Fax App Terms of Use

Welcome to the Fax App operated by iApp Technologies LLP (referred to as “we,” “us,” “our,” or “iApp Technologies LLP”). These Terms of Use (“Terms”) govern your use of the Fax App (“App”), including all related features and services. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please refrain from using the App.

1. Eligibility

You must be at least 16 years old (or the minimum legal age in your jurisdiction) to use the App. By using the App, you represent and warrant that you have the legal capacity to enter into this agreement.

2. Description of Service

Fax App provides digital fax services that allow users to:

• Send and receive faxes via the internet;
• Purchase or rent dedicated fax numbers;
• Use document scanning and image processing tools;
• Combine multiple files into a single fax;
• Manage fax history and documents.

The App is available in 80+ countries, depending on local telecommunications regulations and third-party fax provider availability.

3. Account Registration and Security

• You may sign in using Apple Sign In or other available login options.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to notify us immediately at iappllp650@gmail.com if you suspect unauthorized access to your account.
• You are responsible for all activity that occurs under your account.

4. Subscription, Credits, and Payments

• Some features of the App require a paid subscription or credits.
• Payments are processed through the App Store or other payment processors.
• Prices, subscription terms, and renewal conditions will be displayed in the App.
• You can manage or cancel your subscription in your App Store account settings.
• Credits purchased are non-refundable and expire based on the terms shown in the App.
• Fax transmissions consume credits depending on the number of pages and destination.

5. Fax Transmission and Delivery

• The App relies on third-party telecommunication providers to transmit and receive faxes.
• We do not guarantee delivery or timing of fax transmissions due to third-party dependencies.
• Users are advised to check fax confirmation receipts within the App.
• If a fax fails to send, credits may not be deducted depending on the delivery status.

6. User Content

You retain ownership of the documents, files, and other materials (“User Content”) you upload, scan, or transmit through the App. However, by uploading content, you grant iApp Technologies LLP a limited, non-exclusive, worldwide license to process and transmit your documents as necessary to provide the service.

You agree not to upload or transmit content that:

• Contains illegal, harmful, or offensive material;
• Violates intellectual property rights of others;
• Includes sensitive personal data (medical, financial, biometric) unless necessary;
• Contains viruses, malware, or harmful code.

We reserve the right to remove any content that violates these Terms.

7. Third-Party Services

Fax App integrates third-party services for fax delivery, number provisioning, cloud storage, payments, and analytics (e.g., Firebase Analytics and Crashlytics). Use of these services is subject to their respective terms and privacy policies.

8. Privacy Policy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and store your data. Please review it carefully. The Privacy Policy is available within the App and on our website.

9. Termination and Account Deletion

• You can delete your account at any time from within the App or by contacting iappllp650@gmail.com.
• We may suspend or terminate your account if you violate these Terms or misuse the App.
• Upon termination, your right to use the App immediately ceases, and your data will be handled according to our Privacy Policy.

10. Intellectual Property Rights

All content, trademarks, designs, and software within the App are owned or licensed by iApp Technologies LLP. You are granted a limited, non-transferable, non-exclusive license to use the App for personal, non-commercial purposes only.

You may not:

• Copy, modify, or distribute the App or its content;
• Reverse-engineer, decompile, or attempt to derive source code;
• Use the App for commercial faxing services or resale without prior consent.

11. Disclaimers

The App is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind. We do not guarantee uninterrupted, secure, or error-free service. We are not responsible for fax transmission failures due to external network or service provider issues. You use the App at your own risk.

12. Limitation of Liability

To the fullest extent permitted by law:

• iApp Technologies LLP and its affiliates shall not be liable for indirect, incidental, consequential, or special damages, including loss of data, profits, or business interruption.
• Our total liability for any claim arising from the use of the App shall not exceed the total fees paid by you in the last 12 months.

13. Indemnification

You agree to indemnify and hold harmless iApp Technologies LLP, its officers, employees, and partners from any claims, damages, or expenses arising from:

• Your misuse of the App;
• Your violation of these Terms;
• Your violation of any law or third-party rights.

14. Updates and Modifications

We may update or modify the App, its features, or these Terms at any time. Updates will be posted in the App or on our website. Continued use after updates means you accept the revised Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict of law principles. Any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the courts located in Sahibzada Ajit Singh Nagar, Punjab, India.
